How to Create a Mezcal Brand

Mezcal is a Mexican spirit made from the agave plant, very similar to tequila, but with key differences that reflect its higher quality and broader styles.

As you may have read in the previous article, mezcal can be produced in several regions in Mexico, which opens the door to business competition and opportunities.

Its popularity has exponentially increased during the past years, it has been so big that it has caught the eye of famous investors; even Aaron Paul and Bryan Cranston from the drama series Breaking Bad have created their brand named Dos Hombres in 2019.

Just like these blockbuster stars, several foreign business people, and entrepreneurs have found a cool industry niche where they can embark on.

So if you are wondering how you can profit from this growing business here are two ways in which you can create a mezcal brand even if you are not in Mexico.



But first… a small disclaimer

As you may have read in the Mezcal post we included at the beginning of this post, mezcal can just be made in Mexico and is strictly protected under origin laws. 

Therefore, where you are established ie. in Europe, you cannot import mezcal in bulk and brand it… the brand must be registered in Mexico, otherwise, it cannot be called mezcal (the same happens with tequila).

So… how can you create a mezcal brand from outside of Mexico? Here are two ways!

1. Invest in an existing brand

This could be the easiest way. Probably you want to distribute mezcal within your network but you would like to have control over the brand. Well, you can become a shareholder in a mezcal brand that is looking for investors.

In this way, both parties can benefit from the relationship. They can improve their facilities, hire staff, etc. and you can leverage the distribution possibilities within Europe and/or provide them with capital.



2. Create a brand

If you want full control over the brand from its foundations, you can create a company in Mexico under which you can register the rights to the brand in question. 

Mexican foreign direct investment laws are flexible and welcoming to people like you, by this year (2023) they have even improved in the context of nearshoring as several industries move from China into Mexico.

  1. Secretaria de Administración Tributaria (SAT): in charge of taxes and customs.
  2. Secretaría de Economía: creates statistics of foreign direct investment.
  3. Secretaría de Función Pública: regulatory permissions.
  4. COFEPRIS: regulates products for human consumption.
